Permitting Summary
To operate certain industrial activities within the River Tees Port Health Authority boundary, you must have a permit issued by River Tees Port Health Authority.
A regulated facility includes:
- Installations or mobile plants carrying out listed activities
- Waste operations
- Waste mobile plant
- Mining waste operations
- Listed activity includes:
- Energy – burning fuel, gasification, liquefaction and refining activities
- Metals – manufacturing and processing metals
- Minerals – manufacturing lime, cement, ceramics or glass
- Chemicals – manufacturing chemicals, pharmaceuticals or explosives, storing chemicals in bulk
- Waste – incinerating waste, operating landfills, recovering waste
- Solvents – using solvents
- Other – manufacturing paper, pulp and board, treating timber products, coating, treating textiles
Listed activities are divided into three categories: Part A(1), Part A(2), and Part B.
Part A Permits control activities with a range of environmental impacts, including:
- Emissions to air, land and Water
- Energy efficiency
- Waste reduction
- Raw materials consumption
- Noise, vibration and heat
- Accident prevention
Part B Permits control activities which cause emissions to air.
The permit your business requires depends on the specific processes involved and resulting emissions.
Permits are available from the Environment Agency or River Tees Port Health Authority (the Regulator) depending upon the category your business falls within:
- Part A(1) installations or mobile plants are regulated by the Environment Agency
- Part A(2) installations or mobile plants are regulated by the Local Authority for that area.
- Part B installations or mobile plants are regulated by the Port Health authority, except waste operations carried out at Part B installations, which are regulated by the Environment Agency
- Waste operations or waste mobile plant carried on other than at an installation, or by Part A or Part B mobile plants, are regulated by the Environment Agency
- Mining waste operations are regulated by the environment agency
Eligibility Criteria
Applications must be made on the form provided by River Tees Port Health Authority and must include specified information which will vary depending on the operation.
If further information is required the applicant will be notified by us, and they must provide this information, or the application will be deemed to be withdrawn.
For waste operations, no license will be granted unless the required planning permission has first been granted.
Application Evaluation Process
River Tees Port Health Authority must have regard to the following when considering an application for a Part B permit:
- The applicant must operate a Local Air Pollution Prevention and Control (LAPPC) installation using Best Available Techniques (BAT) for preventing, or where that is not practicable, reducing emissions from any environmental medium from the installation
- A permit shall not be granted unless River Tees Port Health Authority considers the applicant will be able to carry on the activity to a suitable standard that complies with conditions set down within the permit by River Tees Port Health Authority
- The onus is upon the applicant to monitor and demonstrate that the installation is complying with laid down emission objectives. River Tees Port Health Authority has various powers to ensure compliance with conditions imposed, including:
- Refusal of a permit
- Varying the conditions (this may also be requested by the operator)
- Revocation of a permit
- Service of Enforcement notices to reinforce a condition or
- A prohibition notice if the installation involves an imminent risk of serious pollution of the environment requiring the operator to close down all or part of the process and take the necessary steps to stop the risk. The notice can be withdrawn when River Tees Port Health Authority is satisfied that the necessary action to deal with the problem has been taken.
- River Tees Port Health Authority must keep a register of particulars related to any application, permits, variation notices, and enforcement action.

Failed Application Redress

An applicant who is refused an environmental permit may appeal to the Secretary of State. Appeals must be lodged no later than six months from the date of the decision.
Licence Holder Redress

If an application to vary, transfer or surrender an environmental permit has been refused or if an applicant objects to conditions imposed on the environmental permit they may appeal to the Secretary of State.
Appeals must be lodged in relation to a regulator initiated variation, a suspension notice or an enforcement notice, not later than two months from the date the variation notice and in any other case not later than six months from the date of the decision.
